The U.S. Department of Energy and the International Code Council are trading fire over whether the 2024 IECC is worth its upfront cost. For window and door manufacturers, the outcome will shape U-factor, SHGC, and fenestration area limits well into the 2027 code cycle.
A federal fight lands on the fenestration spec sheet
The most consequential energy-code story of the summer isn't a new product or a new standard—it's a public feud between the U.S. Department of Energy and the International Code Council over whether the 2024 International Energy Conservation Code is worth adopting at all. For architects, contractors, and building product manufacturers watching state code cycles, this dispute is now the single biggest variable shaping near-term fenestration specifications.
Over the last month, there has been a public dispute between the U.S. Department of Energy (DOE) and the International Code Council (ICC) over the development of building energy codes, particularly residential energy codes. DOE released a press release asserting that the residential 2024 IECC is not cost effective with excessive incremental first costs and lengthy paybacks. ICC responded with a press release pointing out how this new analysis contradicts DOE's own prior analysis showing the residential 2024 IECC does save consumers money and is cost effective.
The DOE's numbers
DOE's June 26 analysis is aggressive in both tone and figures. The agency found that nationwide adoption of the 2024 IECC would significantly increase housing construction costs and burden American families with what it called costly Green New Scam mandates. DOE's analysis found that the 2024 IECC would increase residential construction costs by more than $9.2 billion annually compared to the 2006 code levels, adding more than $127 billion in cumulative costs nationwide. If states choose to update their energy codes to the 2024 IECC, construction costs for a typical single-family home could increase by as much as $14,000.
"An average payback period of 11 years—as long as 22 years in some cases—for new residential building codes is unacceptable," said Assistant Secretary of Energy Audrey Robertson. "Standard-setting bodies should take note: we prioritize the American homeowner and will not allow erroneous building requirements to push homeownership out of reach."
The ICC's counter
The Code Council pushed back hard. ICC says the U.S. Energy Department is ignoring the energy cost savings the 2024 building energy code will create, while DOE says the savings take too long to realize. In response to DOE's findings, the International Code Council states that the Energy Department is completely contradicting its own findings. For nearly three decades, under Democratic and Republican administrations, after each new edition of the IECC, DOE concluded that the code saved money and energy. A webpage that was recently removed showed that the adoption of the latest energy code will save U.S. homes and businesses $182 billion between 2010 and 2040.
The ICC also questioned DOE's methodology directly. ICC called on DOE to explain the methodology behind its construction cost findings. It pointed out that the agency is continuing to solicit public input through an open Request for Information on how that methodology should be updated.
DOE's own prior determination is difficult to square with the new position. The U.S. Department of Energy issued a determination on the 2024 IECC showing that it achieves a 7.8% site energy savings and 6.6% energy cost savings compared to the previous edition, the 2021 IECC.
Why this matters for fenestration specs
The 2024 IECC is where prescriptive U-factors, SHGC limits, and additional-efficiency credits live for windows, doors, skylights, and curtain wall in most U.S. jurisdictions. Two dynamics are now in play:
- Slower state uptake. Eight states have adopted the 2024 IECC code, either as-is or with amendments, according to a tracker by digital code compliance platform company UpCodes: Colorado, Delaware, Illinois, Nevada, New York, North Dakota, Rhode Island and Utah. Some municipalities have adopted the 2024 IECC as well. With DOE actively discouraging adoption, additional states may pause—prolonging the useful life of 2018- and 2021-IECC-tuned product SKUs.
- The 2027 code is already being written. ICC updates the IECC every three years. It's currently taking comments on the next version of the code, slated for release in 2027. DOE's letter is a shot across the bow at that process.
On Feb. 15 this year, the DOE sent a letter to the ICC, raising serious concerns about the trajectory of the IECC. The purpose of IECC is to provide model building codes that can be adopted to provide energy efficiency gains for communities. However, in recent years, IECC has expanded its scope to focus on areas such as energy generation infrastructure requirements and greenhouse gas emissions. This shift risks undermining existing DOE objectives, the letter said.
And the ripple extends to commercial work. Although the findings focus on residential properties, the code applies to commercial properties as well.
Practical implications
- Architects: Confirm the effective code cycle in every jurisdiction on your board this fall. Specs written to 2024 IECC U-factors and SHGC values may need parallel 2021-based alternates if state adoption stalls.
- Manufacturers: Product roadmaps assuming near-term nationwide tightening of fenestration U-factors should be stress-tested against a slower adoption curve—but not abandoned. States including New York, Illinois, and Colorado are already in.
- Contractors and envelope consultants: Expect more amendment activity at the state level. The mix of prescriptive path, performance path, and R408 additional-efficiency credits will drive which glazing packages and door assemblies actually get bought.
DOE has statutory footing in this fight. DOE is required under the Energy Conservation and Production Act, passed in 1976, to provide input into the IECC and issue a determination. Whether the department's shift moves states, or simply hardens the divide between early-adopter and holdout jurisdictions, the fenestration spec sheet just got harder to future-proof.
